Fifty State Survey of School Siting Laws, Regulations and Policies.

Surveys state laws, regulations, and policy guidance documents regarding the siting of schools on sites contaminated by toxic substances, summarizing their key provisions and listing in an appendix the legal citations for each authority referenced in the survey. The general findings include that 19 states have no laws that regulate the criteria a potential school site must meet, 14 of the remaining 31 states prohibit siting schools in areas that pose health and safety risks due to man-made or natural environmental hazards, and eight states include direction for districts to evaluate site contamination. Vaguely worded criteria rarely provide school districts with the tools necessary to select, evaluate, and either eliminate from consideration, or if absolutely necessary, remediate a contaminated site.
